The Department of the Environment, Tourism, Science and Innovation is proposing to make an amendment to a protected area and is seeking views in consideration of the Human Rights Act 2019, including Aboriginal peoples’ and Torres Strait Islander peoples’ cultural rights.

The amendments to be made are as follows:

Tenure Local Government Area Details of proposal

Lawn Hill Resources Reserves (Arthur Creek, Lilydale, Littles Range, and Widdallion)

Mount Isa City and Burke Shire

Omit the entirety of the following four Lawn Hill Resources Reserves from Nature Conservation (Protected Areas Management) Regulation 2024:

  • Lawn Hill (Arthur Creek) Resources Reserve
  • Lawn Hill (Lilydale) Resources Reserve
  • Lawn Hill (Littles Range) Resources Reserve
  • Lawn Hill (Widdallion) Resources Reserve

It is the department’s view that the above listed Resources Reserves were not validly made as there is no evidence of their previous tenures, a combination of Reserves for Departmental and Official Purposes under the Land Act 1962, being revoked. For this reason, the Land Title Register has since been corrected to reflect the invalid dedication and the tenure of the former Resources Reserves are currently:

  • Lawn Hill (Arthur Creek and Widdallion) as Reserves for Departmental and Official (Natural Resources) Purposes under the Land Act 1962.
  • Lawn Hill (Lilydale, and Littles Range) as Reserves for Departmental and Official Purposes under the Land Act 1962.

Boodjamulla (Lawn Hill) National Park

Omit the entirety of Boodjamulla (Lawn Hill) National Park from the Nature Conservation (Protected Areas) Regulation 1994.

The Boodjamulla (Lawn Hill) National Park is being dedicated as Boodjamulla National Park (Aboriginal Land), therefore will cease to exist.

Mount Isa City and Burke Shire

Redescribe Boodjamulla National Park (Aboriginal Land) under the Nature Conservation (Protected Areas) Regulation 1994, to provide for the dedication and naming of the following additional areas:

  • Lot 19 on DP349325, containing an area of 201,858ha
  • Lots 6 & 63 on DP349317, containing an area of 25,768ha
  • Lot 7 on DP347085, containing an area of 30,440ha
  • Lots 92 & 94 DP347088, containing an area of 11,074ha

Survey plans will be registered and take effect upon signing of the Lease Agreement for national park lands under section 284 of the Aboriginal Land Act 1991, and the deeds to the lands issued.

Comments received by 24 February 2025 will be considered by the department.
