Civil court date set for review

The Department of Environment and Science’s application for an urgent interim restraint order
against NuGrow Ipswich Pty Ltd was heard in the Brisbane Planning and Environment Court on 7 December 2023.
The Court adjourned the matter for further review on 20 December 2023. The matter is likely to be heard early in 2024.
The Court acknowledged the public interest and concerns with respect to the matter, which relates to odour impacts in the community around the Swanbank Industrial Area.
The Department of Environment and Science remains committed to pursuing the matter but is unable to provide further comments while the matter is before the Court.
Meanwhile, our meticulous investigation into potential offences against the Environmental Protection Act 1994 in relation to the Swanbank Industrial Area is continuing.
As the environmental regulator, we take community concerns about the ongoing impacts of odour seriously. We will continue to take enforcement action, including court proceedings, against any operators who are found by the department to be wilfully and unlawfully causing an odour nuisance in the community.
