Court sets date to hear case against Swanbank company

The Brisbane Planning and Environment Court has set 31 January and 1 February 2024 as the hearing dates for the Department of Environment, Science and Innovation’s (DESI) application for an urgent interim restraint order against NuGrow Ipswich Pty Ltd.

The matter has been set down for a two-day hearing where DESI is seeking orders to limit certain aspects of NuGrow’s operations, including receiving certain highly odorous wastes with the aim of bringing relief to the local community.

DESI is committed to pursuing the matter, but we are unable to provide further comment while the matter is before the Court.

As the environmental regulator, DESI takes community concerns about the ongoing impacts of odour seriously.

We will continue to take compliance and enforcement action, including court proceedings, against any operators who are found by the department to be wilfully and unlawfully causing an odour nuisance in the community.
